          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
                                       AS MOOT

               On April 12, 1991, the above-named petitioner-owner filed a 
          petition for administrative review of an order issued on March 
          26, 1991, by the Rent Administrator, concerning the housing 
          accommodation known as 94-05 222nd Street, Apartment 5H, Queens 
          Village, NY, wherein the Administrator determined that certain 
          apartment services were not being provided and reduced the rent 
          accordingly.

               The Commissioner has reviewed all of the evidence in the 
          record and has carefully considered that portion of the record 
          relevant to the issue raised by the administrative appeal.  

               This proceeding was commenced by the filing of several 
          complaints alleging a decrease in various services namely, 
          inoperable intercom, mice and roach infestation, split and torn 
          kitchen linoleum, and damage due to water seepage near kitchen 
          window.  The various complaints are dated June 22, 1988, 
          September 1, 1988, September 9, 1988, and November 1, 1988.  The 
          owner submitted an answer on February 18, 1991 which addressed 
          only the tenant's complaint dated September 9, 1988.  The owner 


contended that the complaint was not mailed by the agency to the

          owner until February 8, 1991.  The owner states that the tenant's 
          complaint of split and torn linoleum had been corrected long 
          before the complaint was received and has been examined by the 
          agency many times. 
           
               By inspection conducted on March 6, 1991, the following 
          findings were made:  visible evidence of mice and roaches, 
          kitchen linoleum patched in an unworkmanlike manner, intercom 
          nonfunctioning.  There was no evidence of any water damage over 
          the kitchen window.  

               By order dated March 26, 1991 and based on the inspection 
          results, the Administrator reduced the rent by $16.50; $6.00 for 
          infestation, $4.50 for kitchen linoleum, and $6.00 for the 
          defective intercom.  

               In the PAR, the owner alleges that the tenant's original 
          complaint dealt only with water damage due to seepage near 
          kitchen window.  The owner states that that complaint was dated 
          September 1, 1988.  The owner submits a copy of his answer to 
          that complaint which is dated December 17, 1990.  The owner 
          contends that none of the other items cited in the 
          Administrator's order were mentioned by the tenant in the 
          original complaint.   

               The Commissioner is of the opinion that this petition should 
          be terminated.

               The Administrator's order hereunder review has been modified 
          by order dated August 31, 1992 under Docket No. FH120007RK.  A 
          petition for administrative review has been filed against the 
          modified order and will be considered by the Commissioner in 
          Docket Number GI120204RO.

               THEREFORE, pursuant to the City Rent Law and the Rent and 
          Eviction Regulations, it is   

               ORDERED, that this petition be, and the same hereby is, 
          terminated in accordance with this order and opinion.
