           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On April 4, 1991, the above-named owner filed a timely Petition  for
        Administrative  Review  of  an  order  issued  on  March  4,   1991,
        concerning t e  housing  accommodations  relating  to   the   above-
        described docket number.  

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the petition.

        On August 14, 1990, the owner commenced this proceeding   by  filing
        an application to restore rent based on restoration of services  and
        tenant's consent to same, for  which  a  rent  reduction  order  was
        issued under the above-described docket number.

        Thereafter on February  14,  1991,  an  inspection  of  the  subject
        apartment was conducted by  a  DHCR  inspector  who  confirmed  that
        services have not been restored.

        On March 4, 1991, the Administrator issued an  order  based  on  the
        inspection report, finding that services  have  not  been  restored,
        denying the owner's application and continuing the rent reduction in 
        effect.

        In  this  petition,  the  owner  contends  that  repairs  were  made
        "immediately upon receiving the order."

        The Commissioner is of the opinion  that  this  petition  should  be
        denied.

        Because the owner  admits  that  repairs  were  made  following  the
        issuance of the  Administrator's  order,  this  order  based  on  an
        inspection finding services not restored was correct when issued.

        This Order and Opinion is issued  without  prejudice  to  the  owner
        filing an application for restoration of services.

        THEREFORE,  in  accordance  with  the   provisions   of   the   Rent
        Stabilization Law and Code, it is

        ORDERED, that this petition for administrative review  be,  and  the
        same  hereby  is,  denied,  and  that  the   order   of   the   Rent
        Administrator be, and the same hereby is, affirmed.
