           ORDER AND OPINION REMANDING PETITION FOR ADMINISTRATIVE REVIEW


               On December 21, 1991, the above-named petitioner-owner filed 
          a petition for administrative review of an order issued on November 
          27, 1991, by the Rent Administrator, concerning the housing 
          accommodation known as 1420 Parkchester Road, Bronx, New York, 
          various apartments, wherein the Administrator determined that the 
          owner failed to submit a response to a DHCR notice dated September 
          5, 1991, which afforded a second opportunity to the owner to 
          correct conditions as revealed by an inspection held at the subject 
          premises on August 5, 1991.  The Rent Administrator further 
          determined that, based on the owner's default, the owner's (second) 
          application to restore the rent, previously reduced by the Rent 
          Administrator on January 27, 1989, is denied based upon the owner's 
          failure to repair the basement wall in a workmanlike manner.

               The Commissioner has reviewed all of the evidence in the 
          record and has carefully considered that portion of the record 
          relevant to the issue raised by the administrative appeal.  

               The issue herein is whether the Rent Administrator properly 
          denied the owner's (second) application for a restoration of the 
          rents.

               On appeal, the petitioner-owner stated that the Rent 
          Administrator erred in issuing the appealed order because he based 
          the order on a failure of the owner to reply to the DHCR notice and 
          that, in fact, it replied to the said notice, on October 15, 1991.  
          In support of this contention, the owner submitted a copy of the 
          reply bearing a DHCR time-receipt stamp, dated October 15, 1991.

               After a careful consideration of the entire evidence of record 
          the Commissioner is of the opinion that the administrative appeal 
          should be remanded to the Rent Administrator for further 
          processing.

               The record clearly supports the owner's statements on appeal. 
          The owner submitted a reply to the DHCR notice dated September 5, 
          1991, but the Rent Administrator failed to consider the reply.

               Accordingly, the Commissioner finds that due process requires 
          that this proceeding be remanded to the Rent Administrator for the 
          purpose of affording the Rent Administrator an opportunity to 
          consider the owner's reply to the DHCR's notice of September 5, 
          1991. 

               THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, and the Rent and Eviction Regulations for New York City, it 
          is

               ORDERED, that this petition be, and the same hereby is, 
          granted to the extent of remanding this proceeding to the Rent 
          Administrator for further processing in accordance with this order 
          and opinion.
