            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW   


          The above-named owner filed a timely petition for  administrative
          review of an order issued concerning  the  housing  accommodation
          relating to the above described docket number.

          The Commissioner has reviewed all the evidence in the record  and
          has carefully considered that  portion  relevant  to  the  issues
          raised by the petition. 

          The owner commenced this  proceeding  by  filing  an  application
          asserting that it had restored and was maintaining  certain  ser-
          vices in the subject building.

          Thereafter an inspection of the subject premises was conducted by 
          a DHCR inspector who indicated that servic s  had  not  been  re-
          stored.    

          The Rent Administrator found, based thereon, that no  restoration
          of services had occurred and further denied the owner s  applica-
          tion.

          In the petition for administrative review, the  owner  states  in
          substance, that leaks have been repaired  and  that  replastering
          and painting will soon be effectuated.


          After careful consideration, the Commissioner is of  the  opinion
          that the petition should be denied.

          The Commissioner notes that the tenant's rent was reduced due  to
          peeling paint and plaster in the bedroom  of  his  apartment  and
          that there exists no evidence in the record which was before  the
          Rent Administrator to indicate that the conditions had been  cor-
          rected.  Moreover, the DHCR inspection conducted on September 16,

          1991 revealed that the conditions still existed.


          THEREFORE, in accordance with the  provisions  of  the  Rent  and
          Eviction Regulations for New York City, it is,

          ORDERED, that this petition be, and the same hereby  is,  denied,
          and the Rent Administrator's order be, and the  same  hereby  is,
          affirmed.
