            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


               The  above-named  owner  filed   a   timely   Petition   for
          Administrative Review against an order issued  on  September  20,
          1991, concerning  the  housing  accommodations  relating  to  the
          above-described docket number.

               The Commissioner has reviewed all of  the  evidence  in  the
          record and has carefully considered that portion  of  the  record
          relevant to the issues raised by the petition.  

               The tenant commenced this  proceeding  on  May  4,  1990  by
          filing  a  complaint  asserting  that  services  in  the  subject
          apartment were not being maintained.

               The Administrator's file does not contain an answer  by  the
          owner to the tenant's complaint.

               On September 6, 1991, a physical inspection of  the  subject
          apartment was  conducted  by  a  DHCR  staff  who  confirmed  the
          existence of defective conditions.

               The Administrator directed restoration  of  services  and  a
          reduction of the stabilized rent.


               In this petition, the owner states that "all of the work  in
          the subject premises has  been  complied  with"  but  submits  no
          documentation to the effect. 

               In reply, the tenant denies the allegations of  the  owner's
          petition and otherwise asserts in substance that repairs were not 
          done.

               After careful consideration,  the  Commissioner  is  of  the
          opinion that this petition should be denied.

               The owner submits no documentation to prove his  contentions
          in the petition.  The petitioner is unclear whether  he  contends
          that repairs had been made before the apartment was inspected  or
          the order was issued, or whether he contends  that  repairs  were
          made following the issuance of the Administrator's order.  If  it
          is the former, then the  owner's  allegation  is  belied  by  the
          report of the agency inspector.  If it is the  latter,  then  the
          Administrator's order based on the  physical  inspection  finding
          decreased services, which warrant a rent reduction,  was  correct
          when issued.   

               This Order and Opinion is issued without  prejudice  to  the
          owner's filing an application for rent restoration based  on  the
          restoration of services, if the facts so warrant.

               THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, it is

               ORDERED, that this petition be,  and  the  same  hereby  is,
          denied, and that the  Administrator's  order  be,  and  the  same
          hereby is, affirmed.
