          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW


               On September 16, 1991, the above-named petitioners  filed  a
          Petition  for  Administrative  Review  concerning   the   housing
          accommodations in the above-described docket numbers.

               The  petitioner  submitted  a  "copy  of  a  stipulation  of
          settlement and general release entered into between the  landlord
          and tenant on September 9, 1991 before Judge Scott, Kings  County
          Civil Court, Housing Part  18,"  which  states  that  the  tenant
          releases and holds the  owner  harmless  of  the  Administrator's
          order under Docket No. ZEJ-210071-S.

               A search of the record reveals that the Commissioner  issued
          an order on July 30, 1991 under Docket No.  FB  210017  RO  which
          determined the issues raised in the instant proceeding.

               Consequently, the  instant  Petition  under  Docket  No.  FI
          210192 RO should be terminated as duplicative and moot by  reason
          of the Commissioner's order under Docket No FB 210017 RO.  

               The owner  is  advised  to  file  an  application  for  rent
          restoration based on the restoration of services if the terms  of
          the alleged settlement so warrant.

               THEREFORE, in accordance with  the  Rent  Stabilization  Law
          and Code, it is


               ORDERED, that this petition be,  and  the  same  hereby  is,
          terminated as duplicative and moot in accordance with the above.
