                    ORDER AND OPINION TERMINATING THE PROCEEDING
           


          On July 3, 1991, the above-named tenant,  filed  a  petition  for
          administrative review of an order issued on June 21, 1991,  by  a
          Rent Administrator concerning the building known as  1855  Bogart
          Avenue, Bronx, New York, wherein the Rent Administrator 
          determined that the owner  was  entitled  to  collect  from  rent
          controlled  tenants  a  rent  increase  based  on  major  capital
          improvements (MCI).

          The Commissioner has reviewed all of the evidence in  the  record
          and has carefully considered that portion of the record  relevant
          to the issues raised by the petition for review.

          The Commissioner notes that the petitioner is a  rent  stabilized
          tenant and, as such, is not required to  pay  the  rent  increase
          granted in the order under review, which concerned only the  rent
          controlled tenants in the building. 

          Accordingly, the Commissioner finds that there  is  no  issue  or
          controversy to be determined  herein  and  that  this  proceeding
          should be terminated.






          THEREFORE, in accordance with  the  Rent  Stabilization  Law  and
          Code, it is         

          ORDERED, that  this  proceeding  be,  and  the  same  hereby  is,
          terminated.
