  ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                                
                                
On  June 4, 1991, the above-named petitioner-tenant filed a Petition
for  Administrative  Review  concerning the  housing  accommodations
known  as  Apartment  10-G at 41 Park Avenue, New  York,  New  York,
wherein  it  was  determined  to  dismiss  the  tenant's  overcharge
complaint.

The  tenant had commenced the instant proceeding on December 9, 1988
by the filing of a rent overcharge complaint.

On  May 1, 1991, the Administrator issued an order under Docket  No.
CL  410257-R,  wherein  it was determined to  dismiss  the  tenant's
complaint  as a duplication of an earlier but identical  proceeding,
i.e.  DRO  Docket No. 3117038-R.  That proceeding was  commenced  on
March  26,  1984,  by the filing of an overcharge complaint  by  the
subject-tenant.  The resulting order, which was issued  on  November
18,  1986, is currently under reconsideration, at the request of the
tenant,  under  Docket  No. EK 410016-RP, and  will  result  in  the
issuance of a new order.

Insofar as the instant rent overcharge proceeding concerns identical
issues,  subject-matter, parties and period of review as the earlier
proceeding 31170328-R, the determination to dismiss the complaint as
duplicative of that proceeding is correct.

THEREFORE, pursuant to the Rent Stabilization Law and Code, it is

ORDERED, that this petition be, and the same hereby is, denied,  and
that the Administrator's order be, and the same hereby is, affirmed.
