          ORDER AND OPINION TERMINATING THE PROCEEDING
                    FOR ADMINISTRATIVE REVIEW
                                
                                
On  May  8,  1991, the above-named tenant filed  a  petition  for
administrative review of a letter written on April 29, 1991 by an
attorney  of  the DHCR Compliance Bureau concerning  the  housing
accommodation  known as Apartment 2-M, 215 Gunhill  Road,  Bronx,
New  York, wherein it was stated that the owner had complied with
an  order issued in Docket No. CK 6205740S and that the case  was
closed.

The  Commissioner has reviewed all of the evidence in the  record
and  has carefully considered that portion of the record relevant
to the issues raised by the petition for review.

In  his  petition  for administrative review the  tenant  alleges
deficient conditions in his apartment.

After  careful consideration the Commissioner is of  the  opinion
that this proceeding should be terminated.

Pursuant  to  the Rent and Eviction Regulations, a  petition  for
administrative  review may be filed against an order  of  a  Rent
Administrator.   The Commissioner notes that a  letter  from  the
Compliance Section of this Division is not a Rent Administrator's
order.  Accordingly, no petition for administrative review may be
filed therefrom and this proceeding should be terminated.

THEREFORE,  in accordance with the Rent and Eviction  Regulations
for New York City, it is

ORDERED,  that  this  proceeding be,  and  the  same  hereby  is,
terminated.
