           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        The above-named tenant filed a timely  petition  for  administrative
        review of an order issued on March 26, 1991, concerning the  housing
        accommodations relating to the above-described docket number.  

        This administrative appeal  is  being  determined  pursuant  to  the
        provisions of 9NYCRR 2520.6(r) and 9NYCRR 2523.4.

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the petition.

        The original proceeding was commenced on December  5,  1990  by  the
        tenant filing a complaint asserting that heat and hot water services 
        are inadequate.

        Thereafter on January 8, 1991, the subject apartment  was  inspected
        by D.H.C.R. which reported...

             "The heat was adequate.  The living  room  temperature  was
             72oF and the outside temperature was 41oF.

             The hot water temperature was adequate in the  kitchen  and
             bathroom.  The temperature was 120oF."


        Based on said inspection, the Administrator denied on March 26, 1991 
        the tenant's application for a rent reduction.

        In this petition, the tenant repeats its contention that  "heat  and
        hot water are inadequate continuously and intermittently."

        After careful consideration, the Commissioner is of the opinion that 
        this petition should be denied.
        The tenant's unsubstantiated assertions is belied by the  report  of
        the agency inspector who confirmed that heat and hot water  services
        were adequately provided.

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,

        ORDERED, that this petition be, and the same hereby is, denied,  and
        that the District Rent Administrator's order be, and the same hereby 
        is, affirmed.
