DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

          ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW,
                   IN PART, AND MODIFYING ADMINISTRATOR'S ORDER

        On April 22, 1991, the above-named owner filed a timely Petition for 
        Administrative  Review  of  an  order  issued  on  March  20,  1991,
        concerning t e  housing  accommodations  relating  to   the   above-
        described docket number.  

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the petition.

        On February 22, 1990, the owner commenced this proceeding by  filing
        an application to restore rent  based  on  the  restoration  of  all
        services.

        Although duly notified to do so on March 26, 1990, the tenant failed 
        to respond to the owner's application.

        Thereafter on December 5, 1990, an inspection of the subject housing 
        accommodation was conducted by a D.H.C.R.  inspector  who  confirmed
        that services have been restored.

        On March 20, 1991, the Administrator issued an order  based  on  the
        inspection finding that services have been  restored,  granting  the
        owner's application, and restoring rent effective March 1, 1991.

        In this petition, the owner contends that all services were restored 
        as of November 1989 and that the effective date of rent  restoration
        should therefore not be March 1, 1991, but November 1, 1989.

        The Commissioner is of the opinion  that  this  petition  should  be
        granted in part and the Administrator's modified accordingly.

        Administrative policy and precedent have ruled  that  the  effective
        date of rent restoration should be the month following the date when 
        the tenant was informed of the owner's application.  In  this  case,
        the tenant was notified in March 1990.  The  effective  date  should
        therefore be April 1, 1990.  The effective date of the order 

        appealed from should be changed to reflect April 1, 1990.

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        it is

        ORDERED, that this petition be, and the same hereby is,  granted  in
        part, and that the District Rent Administrator's order be,  and  the
        same hereby is, modified in accordance with this Order and Opinion.
