  ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                                
                                
On  April  5,  1991,  the above-named petitioner-tenant  filed  a
Petition  for  Administrative Review  (PAR)  against  the  above-
captioned D.R.O. Docket Number.

The  tenant commenced the instant proceeding on December 28, 1988
by filing a complaint of rent overcharge.

A  search of the record reveals that an order was issued on March
13,  1990  under  D.R.O. Docket No. DA 210009-TC wherein  it  was
determined  that the tenant had not been overcharged,  and  which
therefore terminated the proceeding.  The tenant did not file  an
administrative appeal of that order.

On  March  21,  1991,  the Administrator issued  an  order  which
terminated  the instant proceeding as duplicative of  the  issues
resolved in the above-order DA 210009-TC.

The  tenant's  petition requests a review of "recent overcharges"
but  otherwise  fails  to specify a reason  for  challenging  the
Administrator's determination.

Insofar  as the petition fails to state a reason why the subject-
order  was  improper, and insofar as the Division of Housing  and
Community  Renewal's  (DHCR)  prior  order  concerning  identical
issues  to  the instant proceeding has not been appealed  by  the
tenant, the instant proceeding is hereby terminated.

THEREFORE,  in  accordance with the Rent  Stabilization  Law  and
Code, it is

ORDERED, that this petition be, and the same hereby is terminated
as duplicative and moot in accordance with the above.
