           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On April 17, 1991, the above-named owner filed a timely Petition for 
        Administrative  Review  of  an  order  issued  on  March  14,  1991,
        concerning t e  housing  accommodations  relating  to   the   above-
        described docket number.  

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the petition.

        On October 25, 1990, the owner commenced this proceeding  by  filing
        an application to restore rent based on the restoration of services.

        In its answer filed on January 9, 1991,  the  tenant  asserted  that
        repairs have not been made.

        On  February  20,  1991,   inspection   of   the   subject   housing
        accommodation was  conducted  by   D.H.C.R.,  which  confirmed  that
        services have not been restored.

        On March 14, 1991, the Administrator issued an order based  on  said
        inspection, finding that services have not  been  restored,  denying
        the owner's request for rent restoration  and  continuing  the  rent
        reduction in effect.

        In this petition, the owner states in substance that  services  have
        been restored since March 1, 1988.

        Although the owner contends that repairs were effectuated  prior  to
        the issuance of the Administrator's order,  the  Commissioner  notes
        that the owner submitted insufficient evidence to  substantiate  the
        contention either  while  the  proceeding  was  pending  before  the
        Administrator or by attachment to its petition.  The record  clearly
        shows that inspection  before  the  order's  issuance  reported  the
        existence  of  defective  conditions.   Accordingly,  based   on   a
        preponderance of the evidence the  owner  has  offered  insufficient
        reason to disturb  the  Administrator's  order,  and  it  should  be
        affirmed.

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        it is

        ORDERED, that this petition be, and the same hereby is, denied,  and
        that the District Rent Administrator's order be, and the same hereby 
        is, affirmed.
