            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


               On February 16, 1991 the above named petitioner-owner filed a 
          petition for administrative review against an order issued on 
          January 23, 199l by the Rent Administrator, concerning the housing 
          accommodation known as 35-46 74th Street, Queens, NY, Apartment 
          425, wherein the Administrator amended a previously issued 
          building-wide rent reduction order to add a tenant who had signed 
          the complaint but who had been omitted from the earlier order.

               The Commissioner has reviewed all of the evidence in the 
          record and has carefully considered that portion of the record 
          relevant to the issues raised by the administrative appeal.  

               The record reveals that an order was issued on October 8, 1987 
          ordering a building-wide rent reduction for all rent stabilized 
          tenants who signed the complaint.  On January 7, 1991, the tenant 
          of Apt. 305 wrote to the Administrator, requesting that the order 
          be amended to include his name and apartment.  A copy of the 
          original complaint was submitted, bearing this tenant's signature.  

               The amended order issued on January 23, 1991 added the tenant 
          of Apt. 305 and new orders were issued for every tenant.  The order 
          specifically stated that all other parts of the order remained 
          unchanged. 

               In the petition for administrative review of this amended 
          order, the owner asserts that it was improper to name the tenant of
          Apt. 425 in the amended order which was supposed to affect the 
          tenant of Apt. 305 only.

               The tenant of Apt. 425 responded that he did sign the 
          complaint and was included in the original order.  

               After careful consideration of the evidence of record, the 
          Commissioner is of the opinion that the petition should be denied.

               The order was amended simply to include the tenant of Apt. 305 
          and had no practical effect on the tenant of Apt. 425 who had been 
          included in the earlier order and whose rent had been reduced, 
          effective November 1, 1986 when the order was originally issued on 
          October 8, 1989.  The owner's contention that it was improper to 
          include this tenant in the order issued on January 23, 1991 is 
          misplaced since the amended order merely added the tenant of Apt. 
          305.

               The Commissioner notes that the owner's petition for 
          administrative review of the earlier order was denied on March 28, 
          1991 (Docket No. CA 130376 RO).

               THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, it is

               ORDERED, that this petition be and the same hereby is denied, 
          and the Administrator's amended order issued on January 23, 1991 be 
          and the same hereby is affirmed.
