               ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

            The above-named owner filed a timely petition for administrative 
            review of an order issued on September 5, 1990 concerning the 
            housing accommodations relating to the above-described docket 
            number.  

            The Commissioner has reviewed all the evidence in the record and has 
            carefully considered that portion of the record relevant to the 
            issues raised by the petition.

            The owner commenced this proceeding by filing an application to 
            restore rent based on the restoration of services in the subject 
            apartment.

            In answer, the tenant denied the allegations and otherwise asserted 
            that repairs were not completed.

            On June 15, 1990, an inspection of the subject apartment was 
            conducted by a DHCR staff member who confirmed the continued 
            existence of defective conditions.

            By a notice dated July 11, 1990, DHCR informed the owner to submit 
            within twenty (20) days of the date of the notice any evidence of 
            the completion of repairs, and that "(f)ailure to do so will result 
            in a denial of restoration of rent."

            More than twenty (20) days had elapsed, and the owner failed to 
            comply with DHCR's request.

            On August 29, 1990, the owner filed a copy of an alleged work 
            EI210042RO


            proposal dated August 16, 1990. However, the owner stated that this 
            paper is also evidence of a paid bill and that work was completed on 
            August 18, 1990.







            By an order dated September 5, 1990, the Administrator denied the 
            owner's application, stating that "the owner failed to submit a 
            response to a notice dated July 15, 1990 which afforded a second 
            opportunity to correct conditions as revealed by a June 15, 1990 
            physical inspection."

            In this petition, the owner contends in substance that it submitted  
            a response to DHCR's request, and that the Administrator's order is 
            therefore in error.

            In answer, the tenant stated that the defective conditions still 
            exist.

            After careful consideration, the Commissioner is of the opinion that 
            the petition should be denied.

            Pursuant to Section 2523.4 of the Rent Stabilization Code, DHCR is 
            authorized to order a rent reduction, upon application by a tenant, 
            where it is found that an owner has failed to maintain required 
            services. The owner's petition does not establish any basis to 
            modify or revoke the Administrator's determination based on the June 
            15, 1990 inspection which confirmed the continued existence of 
            defective conditions, warranting a denial of the owner's 
            application.

            The Commissioner notes that by a notice dated July 11, 1990, DHCR 
            informed the owner to submit within twenty (20) days of the date of 
            the notice any evidence of the completion of repairs, and that 
            "(f)ailure to do so will result in a denial of restoration of rent." 
            More than twenty (20) days had elapsed, and the owner failed to 
            comply with DHCR's request. Accordingly, the Administrator properly 
            determined the owner's August 29, 1990 response not timely and 
            correctly denied the owner's rent restoration application.

            The status of the owner's rent restoration applications is as 
            follows: CE210102OR denied on February 9, 1989 and EC210054OR 
            granted on December 5, 1990.

            THEREFORE, in accordance with the Rent Stabilization Law and Code 
            and Operational Bulletin 84-1, it is

            ORDERED, that this petition be, and the same hereby is, denied, and 
            that the Administrator's order be, and the same hereby is, affirmed.
