ORDER AND OPINION TERMINATING PROCEEDING
On June 25, 1990 the above-named tenants filed a petition for
administrative review of the rent agency's "Amended Notice of
Maximum Base/Collectible Rent," dated May 21, 1990, concerning the
housing accommodation known as the Basement Apartment, 292 Carlton
Avenue, Brooklyn, New York.
The Commissioner notes that the above-mentioned notice is not
an order of the rent agency, but was merely a notice in response to
a letter by the subject landlord, dated February 22, 1990, which
requested an "up-dated certified registration record" of the
subject apartment's maximum rent.
The Commissioner further notes that the aforementioned notice
did not make a determination on the merits, but was a restatement
of the rights and obligation already existing between the subject
landlord and the tenants.
As there has been no order issued by the Administrator in this
proceeding for the Commissioner to review, the Commissioner is
accordingly of the opinion that this proceeding should be
terminated.
The Commissioner notes that there is a proceeding currently
pending before the rent agency in which the maximum rent of the
subject apartment is to be determined, under Docket No.
DB 220125-RO.
The Commissioner further notes that this order is issued
without prejudice to any interested parties' right to request a
proceeding to the Administrator, upon written request, to determine

the amount of the maximum rent.
THEREFORE, in accordance with the provisions of the Rent and
Eviction Regulations for New York City, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
