            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

               The above-named tenant filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 4445 Post Road, N.Y.C. 10471, Apt. #8F.

               The Commissioner has reviewed all of the evidence in the 
          record and has carefully considered that portion of the record 
          relevant to the issues raised by the petition.

               The issue before the Commissioner is whether the 
          Administrator's order was correct.

               The Administrator's order being appealed, DK627106BR was 
          issued on April 17, 1990.  In that order, the Administrator granted 
          the owner eligibility for a 1990/91 Maximum Base Rent (MBR) 
          increase.

               On appeal, the tenant individually objected to the 
          Administrator's order.  The tenant alleges the persistence of 
          violations at the subject premises.  He also contends that the 
          owner failed to make various repairs within his respective 
          apartments.

               The Commissioner is of the opinion that this petition should 
          be denied.

               The Commissioner is of the opinion that the alleged 
          persistence of the above-named violations is irrelevant to the 
          Administrator's determination.

               For the grant or denial of eligibility to rely upon the 
          persistence of a particular violation(s) the violation(s) allegedly 
          uncleared must either be rent-impairing in nature or otherwise 
          constitute more than 20% of the violations listed in the List of 
          Pending Violations (LPV); or it must consist of the reduction of an 
          essential service.

               Despite the tenant's contentions made on appeal, an 
          examination of the records reveals that the owner cleared a 
          sufficient number of violations from the subject premises so as to 
          gain eligibility to raise MBRs at the subject premises for 1990/91.

               THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is

               ORDERED, that this petition for administrative review be, and 
          the same hereby is, denied, and that the order of the Rent 
          Administrator be, and the same hereby is affirmed.
