          ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW

               The above-named tenant filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 353 W. 56th Street, New York City, 10019, 
          #4E.

               On May 10, 1990 the above-named tenant filed a petition for 
          administrative review of an order issued on April 6, 1990 by the 
          Rent Administrator concerning the housing accommodation known as 
          apartment 4-E, 353 West 56th Street, New York, N.Y. 10019.

               Subsequently, the landlord's attorney mailed a letter and copy 
          of the Court stipulation, to the rent agency withdrawing its 
          petition for administrative review.

               The Commissioner is accordingly of the opinion that this 
          proceeding should be terminated.

               THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations of N.Y.C., it is

               ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
