            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

               The above-named owner filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 86 Madison Street, various apartments, New 
          York, N.Y.

               The Commissioner has reviewed all the evidence in the record 
          and has carefully considered that portion of the record relevant to 
          the issues raised by the petition.

               The issue before the Commissioner is whether the 
          Administrator's order was correct.

               The Administrator's order being appealed, CJ420056BT was 
          issued on April 16, 1990. In that order, the Administrator revoked 
          the finding of 7M11485M, issued June 29, 1988, that the owner be 
          granted eligibility for a 1986/87 Maximum Base Rent (MBR) increase, 
          due to the owner's meeting the violation certification requirements 
          necessary to the owner's being granted an MBR increase.

               On appeal the owner contends that the one outstanding 
          violation of record at the subject premises has been cleared.  As 
          proof of this contention the owner submits on appeal a copy of a 
          New York City Department of Housing Preservation and Development 
          (HPD) Inspection Order dated September 5, 1989, said Order 
          directing an HPD inspection of the subject premises.  Per the 
          Order, the violation had not been cleared as of August 17, 1989, 
          the date of the most recent HPD inspection prior to the issuance of 
          the Order.

               The Commissioner is of the opinion that this petition should 
          be denied.

               As noted above, the evidence submitted by the owner on appeal 
          indicates that, as of August 17, 1989-over 1 1/2 years after the 
          expiration of the 1986/87 cycle-the one violation of record against 
          the subject premises was still outstanding.

               THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is 

               ORDERED, that this petition for administrative review be, and 
          the same hereby is, denied, and that the order of the Rent 
          Administrator be, and the same hereby is, affirmed.
