            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                                          
               On April 19, 1990 the above named petitioner-owner filed a 
          Petition for Administrative Review against an order of the Rent 
          Administrator issued March 13, 1990. The order concerned housing 
          accommodations known as Apt. 24 located at 304 East 62nd Street, 
          New York, N.Y.  The Administrator directed restoration of services 
          and ordered a rent reduction for failure to maintain required 
          services.  

               The Commissioner has reviewed the record and carefully 
          considered that portion relevant to the issues raised by this 
          appeal.

               The owner's petition for administrative review claims that no 
          rent reduction is warranted because the tenant had been granted a 
          rent reduction in a prior proceeding and is not entitled to more 
          than one rent reduction.  Page 2 of the order appealed herein 
          clearly states: "...for a rent stabilized apartment where such an 
          order is already in effect for any type of decreased services, no 
          further rent reduction is authorized by this order."   The parties 
          are advised that in order to obtain rent restoration, the owner 
          must demonstrate that conditions cited in all outstanding rent 
          reduction orders have been corrected.

               The Commissioner notes that the owner's rent rent restoration 
          application (Docket No. HC410061OR) is pending before the DHCR.

               THEREFORE, pursuant to the Rent Stabilization Law and Code it 
          is

               ORDERED, that this petition be, and the same hereby is, 
          denied, and that the Rent Administrator's order be, and the same 
          hereby is, affirmed.
