                       ORDER AND OPINION TERMINATING PROCEEDING


          On April 30, 1990, the  above-named  petitioner-tenant  filed  an
          administrative appeal against an order issued on April 9, 1990 by 
          the Rent Administrator (92-31 Union Hall Street, Jamaica, New York) 
          concerning the housing accommodations known as 1818 Newkirk Avenue, 
          Brooklyn, New York, apartment C.

          The owner commenced this proceeding by filing an application for a 
          rent increase based on pointing work.

          On July 2, 1986, the Rent Administrator granted the application in 
          part and found that the owner was entitled to an increase based on 
          the amount of his claimed cost minus sales tax.
                     
          On March 13, 1990, the Rent Administrator reopened the proceeding 
          at the request of the tenants who alleged  that  they  had  never
          received copies of the Administrator's order. 

          On April 9, 1990 the Rent Administrator affirmed the order issued 
          on July 2, 1986.

          On appeal, the petitioner-tenant states, in substance, that she was 
          not a tenant at the subject premises on July 2, 1986, however, she 
          did become a shareholder of the cooperative corporation on August 
          29, 1988.

          After a careful consideration of the entire evidence of record, the 
          Commissioner is of the opinion that  this  proceeding  should  be
          terminated.

          According to the evidence of record, when the owner commenced this 
          proceeding, Apartment  C  (the  subject  apartment)  was  vacant.
          According to Division records, the apartment  is  exempt  due  to
          cooperative ownership. Since this apartment is not regulated, the 
          tenant has no standing to file an administrative appeal.

          THEREFORE, in accordance with the applicable provisions of the Rent 
          Stabilization Law and Code, the Rent and Eviction Regulations for 
          the City of New York, and Operational Bulletin 84-1, it is

          ORDERED, that this administrative appeal proceeding be,  and  the
          same hereby is, terminated.
