            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW
                        
               
               On November 20, 1990, the above-named owner filed a  petition
          for administrative review of an order issued on November  7,  1990
          by  a  District  Rent   Administrator   concerning   the   housing
          accommodations known as Apartment E1F, 205 West Post  Road,  White
          Plains,  New  York,  wherein  the  owner's  application  for  rent
          restoration based on a restoration of services was denied.        

               The Commissioner has reviewed all  of  the  evidence  in  the
          record and has carefully considered that  portion  of  the  record
          relevant to the issues raised by the petition for review.  

               On April 17, 1990, the owner filed an application  for   rent
          restoration, stating therein that it had  restored  all  services.
          The application was based on a previously ordered  rent  reduction
          (WDE-8-1-0229-S)  wherein  the  Administrator  determined  that  a
          diminution of services had occurred and reduced the rent.  In that 
          order the Administrator directed the owner to correct  and  repair
          the following:  (1) all bathtub faucets and handles,  shower  head
          and hot water  tap;  screens  to  be  adjusted  to  permit  proper
          ventilation in bathroom; (2) cure ceiling leak  in  bathroom;  (3)
          repair or replace oven thermostat;  (4)  Landlord  to  provide  an
          exterminator; (5) necessary repairs to terrace  to  be  completed.

               In answer to the application for rent restoration the  tenant
          stated, in substance, that the services had not been restored.

               By notices dated June 28, 1990 and on September 6, 1990,  the
          owner was requested to respond to the tenant's allegation that the 
          repairs had not been completed.  The owner failed to respond.  






               In the order herein under review dated November 7, 1990,  the
          Administrator noted the owner's  failure  to  respond,  and  found

          that the owner had not restored the services for  which  the  rent
          was reduced. 

               In its petition for administrative review, the  owner  stated
          that it had submitted a response.  The owner enclosed a copy of  a
          response dated June 13, 1989 and proof of certified mailing.  

               In answer to the petition, the tenant stated that the terrace 
          had been repaired, but that other services had not been restored. 

               The Commissioner finds that this petition should be denied.

               The June 13, 1989 answer submitted  by  the  owner  with  its
          petition  was  the  answer  submitted  to  the  Administrator   in
          response to the tenant's complaint below.  The record contains  no
          proof that the owner submitted an answer to the Division's notices 
          during the restoration proceeding.   Therefore,  the  Commissioner
          finds that  the  Administrator's  order  denying  the  restoration
          request was proper.   

               This order is issued without prejudice to the  filing  of  an
          application for rent  restoration  when  all  services  have  been
          restored. 

               THEREFORE, pursuant to the Emergency  Tenant  Protection  Act
          and the Tenant Protection Regulations, it is

               ORDERED, that this petition  be,  and  the  same  hereby  is,
          denied.
