            ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW
                                          

               On November 13, 1990, the above named petitioner-owner  filed
          a Petition for Administrative Review against an  order  issued  on
          October 9, 1990 by the  District  Rent  Administrator,  99  Church
          Street, White Plains, N.  Y.,  concerning  housing  accommodations
          known as Apartment 3B at 63 Garfield Street, Yonkers, N. Y. 

               The Commissioner has reviewed all  of  the  evidence  in  the
          record and has carefully considered that  portion  of  the  record
          relevant to the issues raised by the administrative appeal.  

               This proceeding was originally commenced by the filing  of  a
          rent overcharge complaint by the tenants.  In the  complaint,  the
          tenants contended  that  rent  charged  for  their  renewal  lease
          commencing February 1, 1989 was unlawful  because  the  owner  had
          failed to file an Operating and Maintenance Schedule.

               In answer to the complaint, the  owner  stated  that  it  had
          registered the premises with DHCR since the day it  was  purchased
          in 1985; and enclosed leases and copies of the annual registration 
          summaries for each year.

               In the order  which  is  the  subject  of  this  appeal,  the
          District Rent Administrator determined that the owner  had  failed
          to file a  timely  Operating  and  Maintenance  Schedule  for  the
          1988/89 guideline period and was therefore not eligible to collect 
          a guideline increase for the tenants' lease commencing February 1, 
          1989.  The Administrator directed the owner to refund  $891.83  to
          the tenants, representing overcharges for the period from February 
          1, 1989 to October 31, 1990.






               In this petition, the owner alleged that  the  Operating  and
          Maintenance Expense  Schedule  for  the  1988-1989  guideline  was

          timely filed; that the  owner  has  always  complied  with  filing
          requirements; and that a copy of  the  Operating  and  Maintenance
          Expense Schedule was enclosed.  The owner enclosed a copy  of  the
          1990 Schedule.   

               In answer  to  this  petition,  the  tenants  reasserted  the
          arguments made below.

               The Commissioner is of the opinion that this petition  should
          be granted.

               By resolution  of  the  Westchester  County  Rent  Guidelines
          Board, any owner who  failed  to  file  a  1988  -  1989  Property
          Maintenance and Operations Cost Survey Schedule  on  or  before  a
          prescribed date following receipt of written notice to do  so  was
          ineligible for a guidelines increase for  the  period  October  1,
          1988 - September 30, 1989.  Notice was sent  to  owners  in  March
          1988 advising them to file the schedule within 45 days of  receipt
          or by May 15, 1988, whichever date was later.

               In this case,  an  examination  of  the  evidence  of  record
          reveals that the owner's address on file  with  the  Division  was
          incorrect.  As a result, the Division's  March,  1988  notice  was
          sent to the wrong address and was returned by the Post  Office  as
          undeliverable.  The owner filed the Schedule  on  July  21,  1989.
           
               In light  of  D.H.C.R.'s  failure  to  serve  the  owner  the
          required notice at its correct address, the Commissioner is of the 
          opinion that no penalty is  warranted.   The  owner  is  therefore
          entitled to collect the guideline increase for the tenants'  lease
          commencing February 1, 1989. 

               Any arrears due the owner as a result of this  order  may  be
          paid by the tenants in equal monthly installments over the  course
          of the next six months.  If the tenants should vacate, all arrears 
          will be due immediately.

               THEREFORE,  in   accordance   with   the   Emergency   Tenant
          Protection Act and the Tenant Protection Regulations, it is

               ORDERED, that this petition be and the same hereby is granted 
          and the District  Rent  Administrator's  order  be  and  the  same
          hereby is revoked.
