            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


               On November 1, 1990, the above-named petitioner-tenant timely 
          refiled a petition for administrative review (PAR) of an order 
          issued on August 28, 1990, by the Rent Administrator, concerning 
          the housing accommodation known as 323 West 74th Street, New York, 
          NY, various apartments, wherein the Administrator granted the 
          owner's application for a rent restoration based on the restoration 
          of the services cited in the Administrator's order under Docket No. 
          DA 430006-B.

               The Commissioner has reviewed all of the evidence in the 
          record and has carefully considered that portion of the record 
          relevant to the issue raised by the administrative appeal.  

               This proceeding was commenced by the filing of an application 
          to restore rent by the owner on March 7, 1990, which alleged that 
          the conditions which were the subject of the rent reduction had 
          been corrected.  By notices dated April 19, 20, and 22, 1990 the 
          various tenants of the building including the petitioner confirmed

          that sufficient trash cans were being provided and garbage 
          collection days are posted.  By subsequent agency request, the 
          owner submitted the name of the building janitor and advised that 
          same is displayed on the premises.

               In the PAR, the petitioner-tenant contends that the building 
          was without gas service for the month of July, 1990, having been 
          shut off by Con Edison pending repair of a gas leak; that the 
          tenants filed a complaint in this connection with the Division 
          which was given Docket No. EG43065-B; that there are other repairs 
          which need to be done which petitioner does not specify; and that 
          the rent should not be restored until all repairs are completed. 

               The Commissioner is of the opinion that this petition should 
          be denied.

               In order for a rent restoration application to be granted, it 
          must be established that the conditions cited in the rent reduction 
          order have been corrected.  In this case the rent reduction order 
          that the owner was seeking to have restored described the service 
          not being maintained as "...no garbage cans provided and no sign 
          posted indicating the hour and method of trash collection...."

               The only relevant inquiry in this proceeding is whether that 
          condition was corrected.

               The tenants have confirmed the restoration of the services
          which were the subject of the rent reduction order.  Petitioner's 
          other complaints raised for the first time in the PAR are not 
          reviewable in this proceeding, but will be determined in Docket EG- 
          430065-B.

               THEREFORE, in accordance with the Rent Stabilization Law and 
          Code, it is

               ORDERED, that this petition be, and the same hereby is, denied 
          and the Rent Administrator's order be, and the same hereby is, 
          affirmed.
