               ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


           On October 9, 1990, the above named petitioner-owner filed a Petition 
           for Administrative Review of an order issued on September 25, 1990, by 
           the District Rent Administrator, 50 Clinton Street, Hempstead, New 
           York, concerning housing accommodations known as Apartment 27 at 56 
           Broadway, Freeport, New York, wherein the District Rent Administrator 
           adjusted the Maximum Rent and determined that the tenant had been 
           overcharged.

           The Commissioner has reviewed all the evidence in the record and has 
           carefully considered that portion of the record relevant to the issues 
           raised by the administrative appeal.

           This proceeding was originally commenced by the filing by the owner of 
           a Sixty-Day Notice of Maximum Rent Adjustment.  The owner submitted 
           calculations showing how the tenant's rent had been calculated, 
           including two major capital improvement (MCI) increases.

           In the order under appeal herein, the District Rent Administrator 
           determined the Maximum Rent; determined that there was a discrepancy 
           between the Maximum Rent based on DHCR records and the rent collected 
           by the owner; and determined that the owner was charging the tenant 
           unlawful increases including supplementary adjustments for New York 
           City rent stabilized tenants, a rent guideline for ETPA cooperative 
           tenants, an increase for a refrigerator for which no application was 
           filed and an unauthorized adjustment for a Sixty-Day Notice which was 
           denied.  The Administrator directed the owner to refund overcharges 
           of $2,417.06 to the tenant.

           In this petition, the owner contends that "facts are in error," that 
           the Administrator allowed an increase of $23.73 for 4 years and 
           included two MCI increases, that the tenant rented a garage at 
           another location at a monthly rent of $50.00, and that the 
           Administrator computed  overcharges based  on inaccurate monthly rent

           payments and therefore arrived at an inaccurate conclusion.  The 
           owner requests recomputation of the legal regulated rent and 
           overcharges, if any.

           In answer, the tenant asserts, among other things, that the legal 
           maximum rent and overcharges determined by the Administrator are 
           correct.  The tenant also asserts that the rent paid for the garage 
           was separate from the apartment rent and submits separate garage rent 
           checks.  The tenant also states that he recently vacated the subject 
           apartment and he submits a copy of a Landlord's Report of Vacancy 
           Decontrol filed by the owner dated October 10, 1990 listing a maximum 
           rent of $137.12, the amount determined by the Administrator.   (It is 
           noted that the Administrator adjusted the maximum rent to $150.15 
           effective November 1, 1990.  However, the tenant vacated before that 
           date.)

           The Commissioner is of the opinion that this petition should be 
           denied.

           In challenging the Administrator's order, the owner has the burden of 
           indicating any alleged errors in the Administrator's order with 
           specificity.  In this case, the owner simply states "facts are in 
           error" and notes that the Administrator included two MCI increases.  
           These MCI increases were included by the owner in his own 
           computations.  The owner fails to indicate any specific errors in the 
           calculations.  The separate rental for the garage has no bearing on 
           the calculation of the apartment rent.  It is further noted that the 
           tenant's rental history used to determine the amount of the 
           overcharge was based on the owner's own submission.  The Commissioner 
           therefore finds that the owner has failed to raise any objections 
           which warrant modification of the Administrator's order.
             

           THEREFORE, in accordance with the Emergency Housing Rent Control Law 
           and the Rent and Eviction Regulations, it is

           ORDERED, that this petition be and the same hereby is denied and the 
           District Rent Administrator's order be and the same hereby is 
           affirmed.
