          ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW


          On October 10, 1990,  the  above-named  petitioner-owner  filed  a
          Petition for Administrative Review  against  an  order  issued  on
          September 26, 1990, by the District Rent Administrator, concerning 
          housing  accommodations known as 410 Clinton Avenue, Brooklyn, New 
          York, various apartments.  

          Subsequent thereto, the petitioner filed a petition in the Supreme 
          Court pursuant to Article 78 of the Civil Practice Law  and  Rules
          requesting that the Court direct  the  Division  to  expeditiously
          issue a determination of the petitioner's administrative appeal.

          The issue  herein  is  whether  the  District  Rent  Administrator
          properly reduced the monthly rents of the  subject  apartments  to
          $1.00.  

          The proceeding was initiated by the filing of  a  complaint  of  a
          decrease in building-wide services.


          On March 27, 1990, Miriam Crespo was appointed as Receiver  (after
          mortgage foreclosure) over the subject building.

          On September 26, 1990, the District Rent Administrator established 
          the rent for all regulated  apartments  in  the  subject  building
          effective April 1, 1990, in the amount of $1.00 per  month,  based
          Housing  Preservation  and  Development,  which  found  that   the
          dwelling units constituted a danger to life, health and safety.

          On appeal, the petitioner-owner averred that a  vacate  order  for
          the subject premises does not exist and  that,  consequently,  the
          District Rent Administrator's order is in error.

          After a careful consideration of the entire  evidence  of  record,
          the Commissioner is of the opinion that the administrative  appeal
          should be granted.







          The record  contains  signed  statements  from  four  of  the  ten
          affected tenants in the  subject  building  acknowledging  that  a
          vacate order does not exist.

          Moreover, the record also contains  a  stipulation  of  settlement
          dated March 4, 1991, under Supreme Court of the State of New  York
          Index # 4365/90, in which six tenants acknowledge that  no  vacate
          order was ever placed on the subject premises.

          In view of the absence of any evidence of the existence of  a  New
          York City  Department  of  Housing  Preservation  and  Development
          vacate  order  for  the  subject  premises  and  considering   the
          acknowledgments from the tenants disavowing  the  existence  of  a
          vacate order,  the  Commissioner  finds  that  the  District  Rent
          Administrator erred by issuing the order of  September  26,  1990,
          which established the rent for all  regulated  apartments  in  the
          amount of $1.00 per month.

          If there are arrears due to the owner as a result of  the  instant
          determination, the rent regulated tenants may pay off the  arrears
          in twelve (12) equal monthly installments.

          This order and opinion is issued without prejudice to the right of 
          the tenants to file a complaint of service decrease if  the  facts
          so warrant.

          THEREFORE,  in  accordance  with  the  provisions  of   the   Rent
          Stabilization Law and Code and the Rent and Eviction  Regulations,
          it is 

          ORDERED, that this appeal be and the same hereby  is  granted  and
          that the District Rent Administrator's  order  be,  and  the  same
          hereby is, revoked in accordance with this order and opinion.
