                ORDER AND OPINION TERMINATING PROCEEDING AS WITHDRAWN


               On September 28, 1990, the above named petitioner-owner filed 
          a Petition for Administrative Review against an  order  issued  on
          September 6, 1990, by the Rent Administrator at 55 Church  Street,
          White Plains, New York, concerning housing accommodations known as 
          apartment number 3E at 10 Old Mamaroneck Road, White  Plains,  New
          York, wherein the Administrator directed the owner to  refund  one
          month's security. 

               The Commissioner has reviewed all  of  the  evidence  in  the
          record and has carefully considered that  portion  of  the  record
          relevant to the issues raised by the administrative appeal.  

               This proceeding was originally  commenced  on  September  21,
          1987 by the filing of a complaint, of the collection of an  excess
          security deposit, by the tenant. 

               The owner responded to the complaint noting that  the  tenant
          had been in continuous occupancy since September 1, 1975 and  that
          each of the tenant's leases since that time  had  provided  for  a
          security deposit equal to  two  month's  rent.   The  owner  cited
          Section 64 (2505.4) of the Tenant Protection Regulations (TPR)  in
          support of its argument that:  since the tenant's lease  that  was
          in effect on December 1, 1983  provided  for  a  security  deposit
          equal to two months rent, the owner was entitled to continue  that
          practice as to the subject tenant.   

               In the  appealed  order,  the  Administrator  held  that  the
          owner's retention of a security deposit equal to two month's  rent
          was unlawful and the Administrator directed the  owner  to  refund
          one month's security deposit. 




               In this Petition, the owner seeks the revocation of the order 
          of September 6, 1990.  In addition to filing the instant Petition,

          the owner asked the  Administrator  to  reconsider  the  order  of
          September 6, 1990. 

               Although  afforded  the  opportunity,  the  tenant  has   not
          interposed an answer to the owner's Petition.

               On  October  3,  1990,  the  Administrator  issued  an  order
          amending the appealed order and wherein the  Administrator  denied
          the tenant's claim.  On  October  16,1990,  the  owner's  attorney
          wrote to the Commissioner withdrawing the Petition  based  on  the
          issuance of the Administrator's October 3, 1990 order.

               The Commissioner is  of  the  opinion  that  this  proceeding
          should be terminated as withdrawn.

               The Commissioner finds that the relief sought in the Petition 
          was granted by the Administrator's amended  order  of  October  3,
          1990.  The Commissioner notes  that  neither  party  appealed  the
          October 3, 1990 order.

               THEREFORE, pursuant to the Emergency Tenant Protection Act of 
          1974 and the Tenant Protection Regulations, it is

               ORDERED, that  upon  the  withdrawal  of  the  Petition  this
          proceeding be, and the same hereby is, terminated as withdrawn.
