           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On September 21, 1990, the above-named owner filed a timely petition 
        for administrative review of an order issued on August 17, 1990,  by
        the Rent Administrator of the Gertz Plaza,  Jamaica,  District  Rent
        Office concerning the housing accommodations known as Apartment  1R,
        32-73 43rd Street, Astoria, New York.  

        This administrative appeal  is  being  determined  pursuant  to  the
        provisions of 2520.6(r) and 2523.4 of the Rent Stabilization Code.

        The issue herein is the  effective  date  of  the  rent  restoration
        order.

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issue raised by the administrative appeal.

        The rent restoration order under the above-described  docket  number
        states that on April 25, 1990, a  physical  inspection  showed  that
        radiators are not missing in the living room and kitchen;  and  that
        restoration shall be effective January 1, 1990.

        The said order is not under dispute by the parties, except  for  its
        January 1, 1990 effective date.

        In this petition, the owner alleges in  substance  that  the  tenant
        delayed the repairs by refusing access.

        The Commissioner is of the opinion that  the  tenant's  petition  be
        denied and the Administrator's order affirmed.

        The Commissioner notes that the parties agreed  that  the  radiators
        have been installed; and  that  the  loose  radiator  valve  in  the
        kitchen have been repaired.

        The Commissioner also notes that the owner failed to  follow  proper
        procedure pursuant to Policy Statement  90-5  "Arranging  Repairs/No
        Access Inspections" and  that  its  allegation  of  tenant  refusing
        access is therefore without merit.

        However, a review of the record  indicates  that  the  Administrator
        failed to correctly apply the established procedure in the effective 
        date  of  rent  restoration  orders.   Application  of  the  correct
        processing procedure would more  than  negate  any  benefit  to  the
        tenant based on the arguments raised by the tenant in its  petition.
        As such, and in the absence of a timely petition for  administrative
        review by the owner, the Commissioner finds it appropriate  to  deny
        this appeal.

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        it is

        ORDERED, that this petition be, and the same hereby is, denied,  and
        that the District Rent Administrator's order be, and the same hereby 
        is, affirmed.
