                      ORDER AND OPINION TERMINATING PROCEEDING

        On August 23, 1990 the above named petitioner-landlord filed a 
        Petition for Administrative Review against an order issued on July 26, 
        1990 by the District Rent Administrator, 50 Clinton Street, Hempstead, 
        New York concerning housing accommodations known as Apartment 2B at 
        100 Jerusalem Avenue, Hempstead, New York wherein the Administrator 
        found the lease rents to be lawful, but fined the landlord $250.00 for 
        failure to inform the tenant of the prior tenant's rent and how the 
        initial rent was established.  The order also mentioned in passing a 
        rent reduction order based on a service 
        decrease.

        In this petition, the landlord asserts that the Administrator "has 
        not made a determination regarding the rent which should be paid by 
        the tenant during the reduction."

        The Commissioner is of the opinion that this proceeding should be 
        terminated.

        The landlord's petition is in essence not a challenge to the 
        Administrator's order, because that order does not set the reduced 
        rent to be paid as the result of a service decrease; that was 
        actually done by a previous order.  The landlord's petition is 
        irrelevant with respect to the Administrator's determination and 
        must be dismissed.  However, the Commissioner notes that the 
        landlord made a similar inquiry in a letter of August 22, 1990.  On 
        the bottom of that letter a DHCR staff member answered "[t]he tenant 
        should pay the rent of $690.00 per month while the building-wide 
        reduction is in effect."  A facsimile of this was sent to the 
        landlord's "telefax" number on August 28, 1990.
