          ORDER AND OPINION REMANDING PROCEEDING TO RENT ADMINISTRATOR

          On August 23, 1990, the above-named tenant filed  a  petition  for
          administrative review of an order issued on July  19,  1990  by  a
          ent Administrator concerning the housing  accommodation  known  as
          25 Arden Street, New York, New York, Apartment No. 21, wherein the 
          Rent  Administrator  dismissed  the  tenant's  objection  to  rent
          registration for untimeliness.  

          On December 3, 1990, the above named tenant filed a  petition  for
          administrative review of an order issued by the  Administrator  on
          November  27,  1990,  wherein  the  Administrator  dismissed   the
          tenant's overcharge complaint because the issue of  the  rent  was
          settled in court.

          Since the petitions involve common questions of law and fact,  the
          Commissioner deems it appropriate to consolidate  the  proceedings
          for disposition herein.

          The Commissioner has reviewed all of the evidence  in  the  record
          and has carefully considered that portion of the  record  relevant
          to the issues raised by the administrative appeals.

          The original proceeding was initiated by an  overcharge  complaint
          filed by the tenant, dated June 30, 1986 (AG510155R).

          The tenant took occupancy pursuant to a two-year lease  commencing
          on September 1, 1971 and expiring on August 31, 1973 at a  monthly
          rent of $80.00.




          On September 17, 1987, the owner submitted its answer.  The  owner
          alleged that there was no overcharge in rent, and that the  tenant
          and the owner entered into a stipulation in court (Civil  Court  -
          County of New York, Index No. 98047/84), dated February 21,  1985,
          establishing the rent, and it urged that the Division  of  Housing
          and Community Renewal (D.H.C.R.) should not disturb the  terms  of
          the stipulation.

          In the order under review herein (AG 510155 R), the  Administrator
          dismissed the tenant's complaint, based upon  the  Administrator's
          finding that the parties had settled the matter in court.

          In his petition for administrative review of  that  order  (Docket
          No. AG-510155 R), the  tenant  states  that  the  matter  was  not
          settled.  

          After careful consideration, the Commissioner is  of  the  opinion
          that  this   proceeding   should   be   remanded   to   the   Rent
          Administrator.

          A review of the record reveals that the stipulation (Civ l  Court-
          New York County, Index No.  98047/84),  that  was  signed  by  the
          tenant and the owner, did not decide the issue of whether the rent 
          the tenant was paying exceeded the legal regulated rent.

          Accordingly, the tenant's overcharge complaint should be  remanded
          to the Administrator for processing on  its  merits  and  for  the
          issuance of a new determination.

          The tenant also filed an objection  to  rent  registration,  dated
          October 17, 1986 (Docket No. 059513)  alleging  that  he  did  not
          receive the 1984, 1985, and 1986 apartment registrations.

          The owner did not submit an answer.

          In the order reviewed  herein,  the  District  Rent  Administrator
          determined that the 1984 apartment registration was mailed to  the
          tenant on June 29, 1984, and that the filing of the  objection  to
          rent registration was untimely because it was more  than  90  days
          from the mailing of the 1984 apartment registration.

          The tenant's  petition  asserts  in  substance  that  he  did  not
          receive the 1984, 1985, or 1986 apartment registrations.  







          The Commissioner is of the opinion that this proceeding should  be
          remanded to the Rent Administrator as well, for consolidation with 
          the overcharge proceeding under Docket No. AG510155 R.

          As to the 1984 apartment registration, the tenant  denies  receipt
          and has not  been  presented  with  documentary  evidence  showing
          service upon him.  As to the 1985 and 1986 registrations, the Rent 
          Administrator failed to  determine  whether  the  tenant  received
          those documents.

          Accordingly, the tenant's objection to rent registration should be 
          remanded to the Administrator for processing on its merits and for 
          the issuance of a new determination.

          THEREFORE, in accordance with the Rent Stabilization Law and Code, 
          it is 







          DOCKET NOS. EH-410434-RT and EA-510093-RT
          ORDERED, that the tenants' petitions be, and the same hereby  are,
          remanded to the Rent Administrator for processing of the  tenant's
          overcharge  complaint  and  objection  to  1984,  1985,  and  1986
          registrations (or lack thereof)  on  their  merits,  and  for  the
          issuance of a new determination resolving all issues; and that the 
          orders issued by the Rent Administrator under Docket  Nos.  O59513
          and AG510155R be, and the same hereby are, revoked.

          Tenant filed an overcharge complaint and  objection  to  apartment
          registration stating he did not receive the 1984, 1985,  and  1986
          apartment registration.

          The Administrator dismissed  both  complaints.   The  Commissioner
          finds that the complaints should  not  have  been  dismissed,  and
          remands the proceedings to the Administrator.
