        ORDER AND OPINION TERMINATING PROCEEDING AS MOOT
                                
      On Ausgust 6, 1990 the above named petitioner-owner filed a
Petition  for Adminsitrative Review against an order of the  Rent
Administrator issued July 20, 1990.  The order concerned  housing
accommodations known as Apt 3B located at 340 East  74th  Street,
New  York, N.Y.  The Administrator denied the owner's application
for rent restoration.

      The  Commissioner  has reviewed the  record  and  carefully
considered  that portion relevant to the issues  raised  by  this
appeal.

      The owner commenced this proceeding on October 30, 1989  by
filing  an  application for rent restoration.  The  owner  stated
that services in the subject apartment found to have been reduced
in  a  prior  proceeding  (BG 410137 S) had  been  restored.  The
application was served on the tenant.  The Administrator  ordered
a physical inspection of the premises, which was held on June 25,
1990.  The inspector found evidence of peeling paint and plaster,
leaks  and  water stains on the living room ceiling.   The  order
here under review, denying the applcation, duly followed.

      On  appeal, the owner states that the tenant purchased  the
subject  apartment in January 1990.  The tenant filed a  response
wherein   she  stated  that  the  apartment  had,  indeed,   been
purchased.

      After  careful  review of the evidence in the  record,  the
Commissioner  is  of the opinion that this proceeding  should  be
terminated as moot.

      Both parties agree that the subject apartment was purchased
by the tenant.  Accordingly, DHCR no longer has jurisdiction over
this matter.  The proceeding must be terminated.

      THEREFORE, pursuant to the Rent Stabilization Law and Code,
it is ,

      ORDERED,  that this proceeding be, and the same hereby  is,
terminated as moot.
