           ORDER AND OPINION REMANDING PETITION FOR ADMINISTRATIVE REVIEW


               This order and opinion is issued pursuant to an order of the 
          Supreme  Court,  New  York  County,  remanding  an   Article   78
          proceeding to the Division of Housing and Community Renewal for a 
          determination of the owner's petition for administrative review.

               The instant matter stems from an  application  for  a  major
          capital improvement rent increase, filed  with  the  Division  on
          January 22, 1988, predicated on the installation of  new  windows
          at a claimed cost of $52,195.00.  Various  tenants  responded  to
          the application in which they questioned the extent  and  quality
          of the work performed.  

               On July 6, 1990 the Administrator issued the order  appealed
          herein denying the owner's application based on the fact that  an
          order (DG 530059-B) of rent reduction, due to the owner's failure 
          to maintain services of a building-wide  nature,  was  issued  on
          June 11, 1990 and was outstanding against the  subject  premises.

               In  this  petition  for  administrative  review  the   owner
          contends, in substance, that the Administrator was  in  error  in
          denying the instant application prior to the time allowed for 


          filing restoration papers, which papers were timely filed on July 
          16, 1990.  Submitted therewith  is  a  copy  of  a  petition  for
          administrative review (assigned Docket No. EG 520202-RO) against
          the aforesaid rent reduction order.  

               After a careful consideration  of  the  entire  record,  the
          Commissioner is of the opinion that  this  proceeding  should  be
          remanded to the Rent Administrator.

               It  is  the  established  position  of  the   Division,   as
          reflected in Policy Statement 90-8, that where there  is  a  DHCR
          order in effect determining a failure to maintain a building-wide 
          service which resulted in a rent  reduction  and  the  owner  has
          timely filed a Petition for Administrative Review (PAR), the  PAR
          will be expedited to determine whether the service  order  should
          be a bar to the MCI rent increase.

               In this connection the records of the Division confirm  that
          the owner herein  filed  a  timely  petition  for  administrative
          review of the June 11, 1990 order of rent  reduction  challenging
          the propriety thereof,  which  proceeding  is  currently  pending
          before the Division.  The Commissioner is  thus  of  the  opinion
          that the Administrator acted prematurely in denying  the  instant
          application.  

               In view of the constraints of time the Commissioner deems it 
          appropriate to remand this proceeding to the  Rent  Administrator
          for such further processing as may be deemed  warranted,  pending
          resolution of the related administrative appeal proceedings.

               THEREFORE, in accordance with the  provisions  of  the  Rent
          Stabilization Code and the Rent and Eviction Regulations,  it  is

               ORDERED, that this petition  be,  and  the  same  hereby  is
          granted to the extent of remanding this  proceeding  for  further
          processing in accordance with this order and opinion.
