            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

          On May 18, 1990 the above-named petitioner filed a  Petition  for
          Administrative Review against an order  issued  on  February  16,
          1990 by the Rent Administrator, 92-31 Union Hall Street, Jamaica, 
          New York concerning housing  accommodations  known  as  601  West
          164th Street, New York, New York, various apartments.

          On July 19, 1990 the Commissioner issued  an  order  and  opinion
          dismissing the petition as untimely  filed.   As  the  result  of
          litigation  this  matter  was  remitted  to  the   Division   for
          consideration of the petition on its merits.

          The  order  of  the  Administrator  appealed  herein  denied  the
          application  for  a  major  capital  improvement  rent   increase
          (intercom system) and terminated the proceeding.  Said order  was
          predicated upon the owner's failure to respond to  notices  dated
          December 6, 1989 and January 9, 1990  requesting  the  submission
          of information/evidence necessary for the continued processing of 
          the application.  The owner was requested,  among  other  things,
          to clarify discrepancies as to the number apartments, room count, 
          rental income as well as proof of service of the  application  on
          the tenants.  

          In this petition the owner, by its agent, requests  reinstatement
          of the application, contending, in substance, that the notices in 
          question were not received by the "undersigned".  Submitted  with
          the petition is  a  hand  written  "Telecopy  Cover  Page"  dated
          February 12, 1990 and a purported FAX submission in  response  to
          said notices.

          After  a  careful  consideration  of  the  entire   record,   the
          Commissioner is of the  opinion  that  this  petition  should  be
          denied.

          The petitioner's allegation that the Administrator's notices were 
          not received by the "undersigned" is without merit in that  there
          was no requirement that  the  signatary  to  the  petition,  Juan
          Sinnreich, be served with  said  notices.   The  "Telecopy  Cover
          Page" of a purported FAX submissions, dated  February  12,  1990,
          belies the owner's contention that it did not receive the notices

          in question.  Not only has the owner failed to  established  that
          the purported FAX submission was actually sent or received by the 
          Administrator, but the Commissioner notes  that  service  by  FAX
          does not constitute a valid or proper method of service upon  the
          Division (Accord DA 410257-RO).  Accordingly, the Commissioner is 
          of  the  opinion  and  finds  that  the   Administrator's   order
          terminating the proceeding below, based on the failure to  submit
          requested information and evidence,  is  correct  and  should  be
          affirmed.

          THEREFORE,  in  accordance  with  the  provision  of   the   Rent
          Stabilization Law and Code and the Rent and Eviction  Regulations
          for New York City, it is

          ORDERED, that this petition be, and the same  hereby  is  denied;
          and that the order of the Rent Administrator  be,  and  the  same
          hereby is affirmed.
