            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW



              The above-named owner filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 1376 Third Avenue, Apt. 4R, New York, New 
          York.

              The Commissioner has reviewed all the evidence in the record 
          and has carefully considered that portion of the record relevant to 
          the issues raised by the petition.

              The issue before the Commissioner is whether the 
          Administrator's order was correct.

              The Administrator's order being appealed, DH430093BO was issued 
          on March 30, 1990.  In that order, the Administrator affirmed the 
          finding of 7MD10662M, issued April 14, 1989, that the owner be 
          denied eligibility for a 1986/87 Maximum Base Rent (MBR) increase, 
          due to the owner's failure to serve an Affidavit of Service 
          (Affidavit) on the Administrator notifying it that the tenants had 
          been informed of the owner's eligibility.

              On appeal, the owner states that the Administrator's order 
          should be overturned because neither 7MD10662M, nor a letter sent 
          out January 6, 1989 from the Administrator to the owner requesting 
          the Affidavit were addressed to the owner but were instead 
          addressed to the former owner.  On appeal the owner testifies that 
          he entered into possession in late 1987.  An examination of 
          D.H.C.R. files reveals that the current owner was the registered 
          owner of the subject premises as of April 1, 1989 and that he had

          acquired possession by, at the latest November 1988.  The owner 
          submits on appeal a letter dated August 15, 1989 from the former 
          owner stating that he had been preoccupied with the sale of the 
          building and had thus neglected to file the Affidavit with the 
          Administrator.  The owner had made a similar argument below.

              The Commissioner is of the opinion that this petition should be 
          denied.

              An assignee does not have better rights than an assignor.  It 
          is undisputed that the assignor (the former owner) had a duty to 
          serve the Affidavit on the Administrator.  The assignor having 
          failed to discharge that duty, it is now the responsibility of the 
          assignee (the present owner).  

              THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is

              ORDERED, that this petition for administrative review be, and 
          the same hereby is, denied, and that the order of the Rent 
          Administrator be, and the same hereby is, affirmed.
