                     ORDER AND OPINION TERMINATING PROCEEDINGS

     On May 10, 1990  the  abovenamed  petitioner  owner  filed  Petitions  for
     Administrative Review against orders issued on April 26, 1990 by the  Rent
     Administrator concerning the housing accommodations known as 1261 and 1271 
     Ocean Avenue, Various Apartments, Brooklyn.

     Since the petitions  involve  the  same  owner  and  the  same  issue  the
     Commissioner deems it appropriate to consolidate them.

     The herein appealed orders of the Rent  Administrator  revoked  1987  fuel
     cost adjustments and suspended all such adjustments for a  year  based  on
     the owner's failure to file 1987 reports of fuel price decreases.

     In its petitions the owner alleges  that  it  did  not  file  the  reports
     because it had not filed for nor collected any fuel cost adjustments since 
     1980.  

     Since the owner, in fact, had obtained fuel cost adjustments in  1980,  it
     was obliged to file reports of price decreases which  was  concededly  not
     done.

     However, the Commissioner notes that the  Administrator's  orders  applied
     only to the cumulative fuel cost adjustments and not to the base rents  of
     the apartments.  If the owner has  not,  in  fact,  been  collecting  such
     adjustments, there have not been any actual rent reductions and no refunds 
     are due the tenants.

     Therefore, the owner has not been aggrieved by the Administrator's  orders
     and there is no active issue herein.

     THEREFORE, pursuant to the Rent and  Eviction  Regulations  for  New  York
     City, it is

     ORDERED, that these proceedings be, and the same hereby  are,  terminated.
     The stay previously issued on July 13, 1990 is hereby vacated.
