           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW


     On March 8, 1990, the above-named tenant filed this administrative  appeal
     of an order issued on February 7, 1990, by the Rent Administrator at 92-31 
     Union Hall Street, Jamaica, New York concerning the housing accommodations 
     known as apartment 2H at 60 Thayer Street, New York, New York.

     The issue herein--determined under the provisions of 9 NYCRR 2520.6(r) and 
     2523.4 -- is whether the Administrator properly determined  to  grant  the
     application of the owner of the aforementioned apartment, for  restoration
     of the rent thereof to its level prior to the reduction imposed  by  order
     number US-002316-S (plus subsequent lawful increases).

     The file in this matter, along with other records of the  above-referenced
     Division, reveals: that in 1986 the Rent Administrator reduced the subject 
     rent due to a finding that certain services were  not  being  provided  or
     maintained; that pursuant to the owner's subsequent application to restore 
     the rent, the Administrator found after an inspection that those  services
     had been restored;  and  that  the  rent  restoration  here  appealed  was
     therefore ordered.

     The  tenant's  petition  points  to   two   claimed   errors:   that   the
     Administrator's findings  were  inaccurate;  and  that  other  outstanding
     complaints of service violations precluded the issuance of  the  order  in
     question.

     After  careful  consideration  of  the  entire  evidence  of  record,  the
     Commissioner is of the opinion that the petition should be denied.

     The petitioner's first argument states that  "the  [unspecified]  repairs"
     were not in fact finished.  Since the petitioner does not suggest a reason 
     to discount the  Administrator's  findings,  which  were  based  upon  the
     Division's inspection of the subject  apartment,  this  argument  must  be
     deemed frivolous.

     In the other assignment of error, the tenant lists several  service  items
     as to which she has filed complaints, arguing that  although  the  subject
     reduction was not because of them, those complaints should have been

     considered before  the  rent  was  restored.   This  proceeding,  however,
     pertains  only  to  the  violations  found  in  order   US-002316-S,   and
     specifically, to whether the Administrator has properly  found  that  they
     have been eliminated.   Other  complaints  are  treated  separately,  with
     separate inspections, etc., and while they  may  result  in  another  rent
     reduction, they are not germane to the issue now before the  Commissioner:
     whether the reduction imposed by order US-002316-S was properly  rescinded
     in the order of February 7, 1990.  No cause having  been  shown  to  upset
     that order, it must be upheld.

     THEREFORE, in accordance with the provisions of the Rent Stabilization Law 
     and Code, it is

     ORDERED, that this petition be, and the same hereby is  denied,  and  that
     the order of the Rent Administrator be, and the same hereby is, affirmed.
