              The above-named owner filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 530 West 144th Street, Various Apartments, 
          New York, New York.

              The Commissioner has reviewed all the evidence in the record 
          and has carefully considered that portion of the record relevant to 
          the issues raised by the petition.

              The issue before the Commissioner is whether the 
          Administrator's order was correct.

              The Administrator's order being appealed, DL520018BO was issued 
          on February 23, 1990.  In that order, the Administrator affirmed 
          the finding of 7M09394M issued November 15, 1989, that the owner be 
          denied eligibility for a 1986/87 Maximum Base Rent (MBR) increase, 
          due to the owner's failure to timely pay the MBR Fee to the 

              On appeal, the owner claims that it first became aware of its 
          above-mentioned liability during October 1989.  The Commissioner 
          notes that the previous owner filed both the Violation and the 
          Operation and Maintenance Certifications with the Administrator 
          during 1985, and that the Administrator's conditional order of 
          eligibility, which was issued on May 5, 1987 under the Docket 
          #7M09394M was addressed to the previous owner.

              The Commissioner is of the opinion that this petition should be

              An assignee has no better rights than an assignor.  The 
          Commissioner is therefore of the opinion that it is irrelevant 
          whether it was the acts or omissions of the former owner (the 
          assignor) or of the current petitioner-owner (the assignee) in 
          determining that the owner be denied eligibility to raise MBRs at 
          the subject premises.

              Even if the rights of the current owner were judged to be 
          superior to those of the former owner, the Commissioner notes that 
          the current owner of the subject premises became the registered 
          owner on April 1, 1988.  The Commissioner deems this nearly 1 1/2 
          year period (from April 1, 1988 until the owner "first became 
          aware" of its liability in September 1989) to be ample time in 
          which the owner was able to learn of the uncollected MBR Fee 

              THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is

              ORDERED, that this petition for administrative review be, and 
          the same hereby is, denied, and that the order of the Rent 
          Administrator be, and the same hereby is, affirmed.
