            ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

              The above-named owner filed a timely petition for 
          administrative review of an order issued concerning the housing 
          accommodations known as 203 West 85th Street, Various Apartments, 
          New York, New York.

              The Commissioner has reviewed all the evidence in the record 
          and has carefully considered that portion of the record relevant to 
          the issues raised by the petition.

              The issue before the Commissioner is whether the 
          Administrator's order was correct.

              The Administrator's order being appealed DK420024BO was issued 
          on February 23, 1990.  In that order, the Administrator affirmed 
          the finding of 7MRE00006M issued November 15, 1989, that the owner 
          be denied eligibility for a 1986/87 Maximum Base Rent (MBR) 
          increase, due to the owner's failure to pay the MBR Fee in a timely 
          manner.

              On appeal, the owner contends that the Administrator's order is 
          violative of the owner's due process rights.  The owner bases this 
          contention on the fact that it took possession of the subject 
          premises in May, 1986 and that it never applied for a 1986/87 MBR 
          increase at the subject premises.  The owner mountains that it did 
          not learn of its liability until it received a letter from the 
          Administrator during 1989 requesting payment

              The Commissioner is of the opinion that this petition should be 
          denied.

              An assignee has no better rights than its assignor.  
          Accordingly, whether the failure to meet the requirements for 
          1986/87 MBR eligibility was due to acts or omissions of a former

          oowner, or those of the current owner, is irrelevant.  Since those 
          requirements weren't met no MBR rent increases are warranted for 
          that period.

              THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations, it is

              ORDERED, that this petition for administrative review be, and 
          the same hereby is, denied, and that the order of the Rent 
          Administrator be, and the same hereby is, affirmed.
