DHCR Petition for Administrative Review (PAR) Decisions
In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

                 ORDER AND OPINION REOPENING ADMINISTRATIVE REVIEW
                       PROCEEDING FOR FURTHER CONSIDERATION


     On January 10, 1990, the above-named petitioner-owner filed a Petition for 
     Administrative Review against orders issued on April 21, 1990 December  1,
     1989, by the District Rent Administrator, Gertz Plaza, Jamaica, New  York,
     concerning housing accommodations located at 11-25 46th Road, Long  Island
     City, New York.

     On  March  22,  1990,  the  Commissioner  issued  an  Order  and   Opinion
     dismissing the proceeding as not being filed within 35 days as  set  forth
     in Operational Bulletin 84-1.

     Subsequently the owner commenced a timely article  78  proceeding  seeking
     judicial review of the Commissioner's order of dismissal.   Thereafter  by
     letter dated July 6, 1990, the petitioner,  by  its  attorneys,  requested
     that the Commissioner's order of dismissal be reviewed  and  the  petition
     reconsidered for Administrative Review.

     In  support,  the  petitioner's  attorney's  submitted  a  copy   of   the
     Commissioner's order of dismissal to establish that the petition was filed 
     with the Division of Housing and Community Renewal on November 10, 1990.

     Based on the above, it is the opinion of the Commissioner that the  filing
     of the Petition for Administrative  y  the  owner  complies  with  thirty-
     five(35) day filing requirement of Operation Bulletin 84-1.

     Pursuant to Operational Bulletin 84-1,  the  Commissioner  may  review  an
     order where the order was the result of irregularity in vital matters such 
     as, in this instance, the  timely  filing  of  the  owner's  petition  for
     Administrative Review.










     Based on the foregoing, this  order  is  issued  pursuant  to  Operational






     DOCKET NUMBER: EA 130379-RO
     Bulletin 84-1 based on an  irregularity  in  vital  matters  in  that  the
     petitioner-owner timely filed  its  petition  for  Administrative  Review.
     Said order revokes, March 22, 1990 dismissal  and  preserved  for  further
     determination the owner's petition for Administrative Review.

The New York State Division of Housing and Community Renewal (DHCR) is the state agency that administers the Rent Stabilization and Rent Control systems. DHCR has jurisdiction over many aspects of the landlord-tenant relationship, including the legal rent, the providing of various services and complaints of landlord harassment. In addition, landlords are able to apply to DHCR for increases in rent based on Major Capital Improvements or for other reasons.

Tenants and Landlords may initiate proceedings by filing complaints or applications with DHCR. After the agency collects evidence from both the tenant and landlord, it renders a decision by the District Rent Administrator (DRA) -- sometimes referred to as the District Rent Office (DRO).

Either party may then appeal the decision at the agency level by filing a Petition for Administrative Review (PAR) within 35 days. A PAR decision -- or sometimes called a Commissioner's Decision -- represents the final decision of the agency before parties may appeal in the state courts.
