          ORDER AND OPINION TERMINATING PROCEEDING FOR ADMINISTRATIVE REVIEW

          On March 16, 1990 the above-named petitioner-owner filed a petition 
          for administrative review (PAR) of an order issued on March 8, 1990 
          by a Rent Administrator, Gertz Plaza, Jamaica, New York, concerning 
          the housing accommodations known as 2682 Creston Avenue, Bronx, New 
          York, various apartments, wherein the Rent Administrator denied the 
          owner's application for a rent increase based on a major capital 
          improvement (MCI).  The owner simultaneously requested the 
          reopening of the proceeding by the Administrator.

          A review of the record in the instant case indicates that the 
          Administrator issued a notice under Docket No. EL630003RK in 
          December 1990, reopening the proceeding under Docket No. 
          BI630159OM.  On May 17, 1991 the Rent Administrator issued an order 
          under Docket No. EL630003RK granting the relief requested.  In 
          addition, on February 10, 1992 the petitioner herein advised the 
          Division that he wished to withdraw his Petition for Administrative 
          Review.

          In view of the foregoing, the Commissioner is of the opinion that 
          this administrative appeal proceeding should be terminated.

          THEREFORE, in accordance with the provisions of the Rent 
          Stabilization Law and Code and the Rent and Eviction Regulations 
          for New York City it is,

          ORDERED, that this administrative appeal proceeding be, and the 
          same hereby is terminated.
