          ORDER AND OPINION TERMINATING PROCEEDING FOR ADMINISTRATIVE REVIEW

          On June 18, 1990 The above-named petitioner-owner filed a petition 
          for administrative review (PAR) of an order issued on June 13, 
          1990, by a Rent Administrator, Gertz Plaza, Jamaica,  New York, 
          concerning the housing accommodations known as 222 Bedford Park 
          Boulevard, Bronx, New York, various apartments, wherein the Rent 
          Administrator determined that the owner was entitled to a rent 
          increase based on certain major capital improvements (MCIs).  The 
          owner simultaneously requested the reopening of the proceeding by 
          the Administrator.

          A review of the record in the instant case indicates that the 
          Administrator issued a notice under Docket No. EK630013RK on 
          November 26, 1990, reopening the proceeding under Docket No. 
          BI630158OM.  On May 9, 1991, the Rent Administrator issued an order 
          under Docket No. EK630013RK granting the relief requested.  In 
          addition, on May 7, 1992 the petitioner herein advised the Division 
          that he wished to withdraw his petition for administrative review.

          In view of the foregoing, the Commissioner is of the opinion that 
          this administrative appeal proceeding should be terminated.

          THEREFORE, in accordance with the provisions of the Rent 
          Stabilization Law and Code and Rent and Eviction Regulations for 
          New York City, it is

          ORDERED, that this administrative appeal proceeding be, and the 
          same hereby is terminated.
