                      ORDER AND OPINION TERMINATING PROCEEDING



              On November 29, 1989, the above-named owner filed a petition 
          for administrative review of an order issued on October 27, 1989 by 
          a Administrator concerning various housing accommodations known as 
          292 Woodworth Avenue, Yonkers, New York.

              The Commissioner points out that subsequent to the filing of 
          this petition, the rent agency mailed to the above-mentioned 
          petitioner and to 292 Woodworth Realty (the most recent registered 
          owner of the subject premises) two written inquiries, dated 
          November 23, 1993 and December 15, 1993, as to whether there still 
          is an active issue for the Commissioner to determine in this 
          proceeding.  The record reflects that there has been no response to 
          the above-mentioned inquiries.

              Based upon the above-mentioned facts, the Commissioner finds 
          that this proceeding should be terminated as moot.

              THEREFORE, in accordance with the provisions of the Rent and 
          Eviction Regulations of New York City, it is

              ORDERED, that this proceeding be, and the same hereby is, 
          terminated.
