ORDER AND OPINION TERMINATING PROCEEDING
On November 29, 1988, the above-named owner filed a petition
for administrative review of an order issued on October 27, 1989 by
a Rent Administrator concerning various housing accommodations in
the premises known as 632-650-678 Warburton Avenue, Yonkers, New
York.
The Commissioner points out that subsequent to the filing of
the above-mentioned petition, the above-mentioned owner failed to
respond to several written inquiries by the rent agency, dated
November 23, 1993, December 27, 1993, and January 19, 1994,
respectively, as to whether there is still an active issue to be
determined with respect to the above-mentioned petition for
administrative review.
The Commissioner further points out that Akam Associates, the
current owner of the subject premises, was sent written inquiries
by the rent agency, dated December 14, 1993, January 6, 1994 and
January 28, 1994, respectively, as to whether there is still an
active issue to be determined with respect to the above-mentioned
petition for administrative review.
The Commissioner finds, based upon the record in this
proceeding, that Akam Associates has not informed the rent agency
that there is still an active issue to be determined with respect
to the above-mentioned petition.
Based upon the aforementioned facts, the Commissioner is of the
opinion that there is no longer an active issue to be determined in
Docket No. DL830339RO
this proceeding.
Accordingly, the Commissioner finds that the subject landlord's
petition should be terminated as moot.
THEREFORE, in accordance with the Emergency Tenant Protection
Act of 1974, and the State Tenant Protection Regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
