               On May 18, 1989 the above named petitioner-landlord filed an 
          appeal in accordance with the applicable provisions of the City 
          Rent Law and Regulations against an order issued on April 14, 1989 
          by the Rent Administrator of the Gertz Plaza, Jamaica, New York 
          Rent Office, concerning the housing accommodation known as 4687 
          Park Avenue, Apts. 3, 6, Bronx, New York.

               The issue in this proceeding is whether the Fuel Cost 
          Adjustments should have been suspended for the calendar year 1985.

               The Rent Administrator's order appealed herein suspended all 
          fuel cost adjustments for the period January 1, 1985 through 
          December 31, 1985.

               This order was based upon a finding that the owner of the 
          subject building had previously obtained allowable fuel cost 
          adjustments and failed to timely serve and file the required report 
          of fuel cost decrease by reason of a decrease in the price of #6 
          oil during the calendar year 1984.

               This proceeding commenced on May 3, 1988, under docket number 
          BC850748FR when the Administrator sent a notice to the owner that 
          because of his failure to timely file the 1985 Fuel Report the 
          Administrator was proposing to suspend all Fuel Cost Adjustments 
          for 1985.

               On May 19, 1988 the owner responded by submitting a copy of 
          pages one and two of the required report, stating it had been 
          previously submitted on an unspecified date to the DHCR.  The copy 
          bore no date-stamp or other proof of when or if it had been 
          received by the DHCR.

               On January 5, 1989 the owner was requested to submit a signed 
          copy of Schedule A.  The request bore the same docket number.  
          Nevertheless, on January 18, 1989 the owner submitted a copy of a 
          1988 Report and stated that Schedule A thereof did not require a 
          signature nor did it apply to a building, such as the owner's, 
          which did not use more than one fuel.

               In a requested marked "final," dated March 6, 1989, also under 
          the same docket number, the Administrator stated that the owner had 
          only submitted pages one and two and specifically requested parts 
          four and six of the 1985 Report within ten days.  The owner did not 
          respond to this request. 

               On appeal, the landlord states, in substance, that the DHCR 
          never clearly stated in their original written notice specifically 
          what information they wanted in relation to what year.  The Rent 
          Administrator never returned any written response seeking further 
          clarification of their original notice.

               After a careful consideration of the entire evidence of record 
          the Commissioner is of the opinion that the administrative appeal 
          should be denied.

               9 NYCRR 2202.13 provides that where a landlord has obtained 
          fuel cost adjustments and then there is a finding of a fuel price 
          decrease, within 60 days of the promulgation of the finding of fuel 
          prices, the landlord must serve and file a report of fuel price 

               In early 1985, a finding was promulgated that the price of #6 
          fuel oil had declined during 1984.  The subject landlord was 
          required to file and serve fuel cost decrease report on or before 
          May 15, 1985.

               A review of the record shows that the Division did not receive 
          a 1985 Report from the petitioner until a portion of it was sent in 
          1988 in response to the initial notice.  The Commissioner notes 
          that all notices from the Division bore the docket number of the 
          proceeding below so that the owner knew or should have known the 
          correct year of the documents being requested.  Furthermore, the 
          final notice, which was not responded to, specified that parts four 
          and six of the 1985 Report were being sought.

               Accordingly, the Commissioner is of the opinion the Rent 
          Administrator correctly suspended Fuel Cost Adjustments for the 
          calendar year 1985.

               THEREFORE, in accordance with the applicable provisions of the 
          Rent and Eviction Regulations for New York City, it is

               ORDERED, that this administrative appeal be, and the same 
          hereby is, denied, and that the order of the Rent Administrator be, 
          and the same hereby is, affirmed.
