ORDER AND OPINION TERMINATING PROCEEDING
The petitioner-owner timely filed an administrative appeal against
an order issued on December 12, 1989 by the Rent Administrator, 92-
31 Union Hall Street, Jamaica, NY, concerning the housing
accommodations known as 143-20 37th Avenue, Flushing, NY, various
apartments.
A current review of the appeal reveals that there apparently is no
longer an active issue to be determined in this proceeding. The
owner requested the Administrator to reconsider the order. The
issues raised on appeal are the same issues raised before the
Administrator to reopen the proceeding. The Rent Administrator
reopened the proceeding on March 1, 1990 under Docket No.
EB130012RK, reprocessed the case, and then issued an order on April
17, 1990, which modified his earlier order of December 12, 1989
under Docket No. CA110003OM.
A party aggrieved by the superseding order had the opportunity to
file an Administrative Appeal within thirty-five days after the
date of issuance, however, no such appeal was filed.
THEREFORE, in accordance with the provisions of the Rent
Stabilization Law and Code, it is
ORDERED, that the Administrative Appeal be, and the same hereby is,
terminated.
