ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
The above-named petitioner filed a Petition for Administrative
Review (PAR) against an order issued October 24, 1989 by a Rent
Administrator, 92-31 Union Hall Street, Jamaica, New York,
concerning housing accommodations known as 118-35 Metropolitan
Avenue, Apartment B6, Kew Gardens, New York, wherein the Rent
Administrator determined that the owner was entitled to a rent
increase based on the installation of a major capital improvement.
A review of the record indicates that on February 6, 1990, the
subject tenant requested that his Petition for Administrative
Review be withdrawn and that the Division issue an Order and
Opinion closing the matter.
In view of the foregoing, the Commissioner is of the opinion that
this administrative review proceeding should be terminated.
THEREFORE, in accordance with the Rent and Eviction Regulations for
New York City, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
