RICHARD ALBERT,
RENT ADMINISTRATOR'S
DOCKET NO.:
Petitioner CG110181S
----------------------------------x
ORDER AND OPINION GRANTING PETITION FOR ADMINISTRATIVE REVIEW
AND REVOKING RENT ADMINISTRATOR'S ORDER
On September 7, 1989, the above-named petitioner-owner filed a
petition for administrative review (PAR) of an order issued on
August 28, 1989, by the Rent Administrator concerning the housing
accommodation known as Apartment 6-F, 94-05 222nd Street, Queens,
New York, wherein the Rent Administrator determined that the owner
was not maintaining required services, and ordered a rent reduc-
tion. The owner was also directed to restore the service of the
intercom which was found on an inspection to be inoperable.
The Commissioner has reviewed all the evidence in the record and
has carefully considered that portion of the record relevant to the
issue raised by the administrative appeal.
The Division's records reveal that the Commissioner has determined
in other proceedings, and pursuant to court order, that an intercom
is not a required service in the subject building. (SJR 4776;
Docket Numbers BB130149RT; BB130151RO; BB130356RO; CK110096RO).
Based on this prior determination, the order appealed herein must
be revoked. Any rent arrears due as a result of this order may be
paid back in twelve equal monthly installments.

THEREFORE, in accordance with the provisions of the Rent Stabiliza-
tion Law and Code, it is
