ORDER AND OPINION CORRECTING COMMISSIONER'S PRIOR ORDER AND
OPINION
By Order and Opinion issued on April 1, 1992, the Commissioner granted
the owner's Petition for Administrative Review In Part and directed the
owner 69 First Avenue Associates to refund overcharges of $31,923.22 to
the tenant.
By a letter dated November 2, 1992, the tenant, through her agent
requested that language be added to the Order and Opinion to include the
managing agent to whom the tenant pays her rent as an owner responsible
for refund of the overcharges. It is noted that the mailing address of
the owner and managing agent are the same.
The Commissioner corrects the Order and Opinion issued November 2, 1992
to add the following language:
Both 69 First Avenue Associates and Trafalgar Properties are
jointly and severally liable for making the overcharge refund
of $31,923.22.
In all other respects, the Order and Opinion issued on April 1, 1992
under docket number DF 410284 RT and DK 410101 RO remains the same. The
addition of the language does not change the substance of prior Order
and Opinion and therefore does not give the owner or managing agent the
right to file an Article 78 petition.
