ORDER AND OPINION TERMINATING ADMINISTRATIVE APPEAL
The petitioner-owner timely filed an administrative appeal against
an order issued on May 8, 1989 by the Rent Administrator (92-31
Union Hall Street, Jamaica, New York) concerning the housing
accommodations known as 5525-5528 Jodie Court, 5525-5544 Avenue D
and 5407-5447 Kings Highway, Brooklyn, NY, various apartments.
On May 5, 1992 the owner submitted a letter to the Division
requesting that its petition be withdrawn.
Additionally, the Commissioner notes that the Rent Administrator
reopened the proceeding on June 13, 1990 under Docket Number EI-
210001-RK, reprocessed the case, and then issued an order on
February 28, 1991, which revoked his earlier order of May 8, 1989
under Docket No. ZBK-210151-OM.
A party aggrieved by the superseding order has the opportunity to
file an administrative appeal within thirty-five days after its
date of issuance. Various tenants have in fact filed
administrative appeals under Administrative Review, Docket Nos. FD-
210122-RT, FC-210430-RT and FC-230350-RT which are pending a
determination.
THEREFORE, in accordance with the provisions of the Rent
Stabilization Law and Code, it is
ORDERED, that this Administrative Appeal be, and the same hereby is
terminated.
