ORDER AND OPINION TERMINATING PETITION FOR ADMINISTRATIVE REVIEW
On May 3, 1989 the above-named petitioner filed an administrative appeal
against an order issued on April 17, 1989 by the District Rent Administrator
(92-31 Union Hall Street, Jamaica, New York) concerning the housing
accommodations known as 2104 East 177th Street, Bronx, New York, Apartment
3D, wherein the application for a major capital improvement rent increase
was denied based upon the owner's failure to respond to various notices
requesting the submission of additional documentation.
On appeal the petitioner-tenant states, "Our failure to comply with follow-
up requests was due to non-submission of application, regarding order, to
parties listed on this PAR."
After a careful consideration of the entire evidence of record the
Commissioner is of the opinion that the administrative appeal should be
terminated.
The application was denied because the owner failed to submit
information/evidence required for the processing of the application. There
is, therefore, no issue to be determined herein on this tenant's appeal.
THEREFORE, in accordance with the applicable provisions of the Rent
Stabilization Law and Code, the Rent and Eviction Regulations for the City
of New York, and Operational Bulletin 84-1, it is
ORDERED, that the administrative appeal be, and the same hereby is
terminated..
